Car Accident Lawyer in Los Angeles and California

Rear-end, intersection and freeway crashes. We deal with the insurance companies while you focus on recovering.

The short answer

After a car accident in California, you generally have two years to file a personal injury lawsuit (Code of Civil Procedure § 335.1), and only six months to present a written claim if a government vehicle or dangerous public road was involved (Government Code § 911.2). California uses comparative fault, so you can recover even if you were partly at fault, reduced by your share. Compensation can include medical bills, lost income, vehicle damage, and pain and suffering.

What to do after a crash

  • Get medical care, even if you feel fine at first
  • Photograph the vehicles, the scene and your injuries
  • Get the other driver's insurance and witness contact information
  • Do not give a recorded statement to the other driver's insurer before getting advice

What you may recover

  • Medical bills and future care
  • Lost wages and earning capacity
  • Vehicle repair or replacement
  • Pain, suffering and emotional distress

Frequently asked questions

How long do I have to file a car accident claim in California?

Generally two years from the injury (Code of Civil Procedure § 335.1). Claims against a government entity require a written claim within six months (Government Code § 911.2).

Can I recover if I was partly at fault?

Yes. Under California's comparative fault rule, your recovery is reduced by your percentage of fault but not eliminated.

What if the other driver has no insurance?

Your own uninsured or underinsured motorist coverage may pay. We review every available policy.
