Uber and Lyft Accident Lawyer in California

Passengers, other drivers, cyclists and pedestrians hurt in rideshare crashes. Which policy pays depends on what the driver's app was doing.

The short answer

In California, from the moment a rideshare driver accepts a ride request until the ride is complete, the driver and company must carry primary insurance of $1,000,000 for death, personal injury and property damage (Public Utilities Code § 5433(b)). Lower limits apply when the app is on but no ride has been accepted, and the driver's personal policy usually applies when the app is off. The general deadline to sue is two years (Code of Civil Procedure § 335.1).

Who can make a claim

  • Rideshare passengers
  • Drivers and passengers in other vehicles
  • Pedestrians and cyclists
  • Rideshare drivers hurt by another driver

Why these cases are complicated

Several insurers may be involved, each pointing to the others. We get the trip data that shows the app status at the time of the crash and pursue every available policy.
